Justice Amy Coney Barrett sits on the bench of the Supreme Court, and the contentious circumstances in which her appointment occurred, are unlikely to ever fade from the memory of the country.
After a hurried nomination, Barrett began her Supreme Court tenure one week before Election Day. With a presidential election running through unnatural circumstances—a global pandemic—she is now confronted with a raft of voting-related appeals.
Barrett’s controversial nomination was forced through the Republican-controlled Senate in a
mere month. Among the fact that Donald Trump, Barrett’s benefactor, one of the most divisive presidents ever, her 52-48 Senate vote was one of the closest in history and one of - further instigating controversy.
Her sheer presence on a new 6-3, conservative-liberal bench could change the law in America, impacting abortion and religious rights, LGBTQ protections, the scope of federal environmental regulations, safety in the workplace, and consumer security.
Trump has made it clear that he immediately needed Barrett in position because a critical
electoral case(s) could be determined by the high court, possibly changing the outcome of the election between him and Joe Biden. Several challenges to voting laws are now pending before the court in crucial states such as Pennsylvania and North Carolina.
Barrett’s questionable ideologies and strong public ties with Trump are likely to involve politics in the Supreme Court - possibly negatively impacting the nation’s judicial system. However, Barrett vowed to be fair and independent, "The oath that I have solemnly taken tonight means at its core that I will do my job without any fear or favor and that I will do so independently of both the political branches and of my own preferences".
In the coming days, Barrett will confront immediate cases outside election conflicts over the
future of the Affordable Care Act and the census practices of 2020 that will impact the
distribution of congressional seats.
